Please read these General Terms and Conditions (collectively referred to as the "Agreement") carefully before using the service.
World Sim Racer SAS ("World Sim Racer") provides a driving simulator rental service.
The purpose of these terms and conditions is to specify the terms of use of the service provided by World Sim Racer. World Sim Racer reserves the right to modify the terms and conditions based on the evolution of its activities.

Definitions:
"Simulator" refers to the driving simulation equipment, including a haptic structure (on actuators), a seat, and accessories.
"User" refers to any person using the simulator in accordance with these terms.
"Service Provider" refers to World Sim Racer, the entity responsible for making the simulator available.
"Manufacturer" refers to any entity responsible for the design and manufacture of the simulator.
"Game Software" refers to the computer program used in conjunction with the simulator for driving simulation.
"Partner" refers to the host structure of the World Sim Racer simulators.

 

1. Acceptance of Terms
By using the simulator, you fully and unconditionally accept these terms and conditions of use.

2. Booking and Session Duration
The total duration of each session is 10 minutes. Bookings are valid for a 10-minute session to be used at any time during the partner's opening hours, within 15 calendar days following the booking date.
The user agrees to familiarize themselves with the safety instructions posted at the simulation center partner or available on our website: worldsimracer.com.

3. Eligibility Conditions
The use of the simulation equipment is restricted to users who are at least 12 years old and whose height is at least 130 centimeters. Any user who does not meet this age and height requirement will not be allowed to use the equipment, in accordance with current safety standards and to ensure a safe user experience.
To prevent potential damage to the simulation equipment, the use is limited to users whose weight does not exceed 130 kilograms. Any user exceeding this weight limit will not be allowed to use the equipment to preserve the structural integrity of the equipment and avoid damage risks.
The use of our simulators by minors is subject to the condition that they are supervised by a responsible adult at all times during use. By accepting our general terms, the user acknowledges and accepts this supervision requirement. It is the responsibility of parents, legal guardians, or legal representatives to ensure that a competent adult supervises the use of simulators by minors. World Sim Racer disclaims any responsibility in the event of non-compliance with this requirement.
Users acknowledge that the simulation equipment is self-service, and no age, height, or weight verification is conducted by World Sim Racer. By using the equipment, the user assumes full responsibility for ensuring that their age, height, and weight comply with the restrictions set forth in the agreement. World Sim Racer disclaims any responsibility in case of use by individuals who do not meet these restrictions.

4. Proper Use
The use of the simulator is exclusively intended for automotive simulation using the video game software provided with the service. Improper use of the simulator, including deliberate collisions in the video game software, is strictly prohibited and may result in injury or property damage.
The user acknowledges and agrees that they are committed to using the simulator exclusively during the reserved period. The service provider reserves the right to take appropriate measures in case of non-compliance with this condition, including immediate termination of the rights to use the simulator.
By using our service, the user acknowledges that they have read and understood the instructions for use. The user agrees to review them carefully at least once and familiarize themselves with them. The user agrees not to bypass these instructions without having previously read their content. This step is designed to ensure responsible and compliant use of our service.

5. Modifications and Alterations
The user acknowledges and agrees that no modification, alteration, or addition can be made to the simulator, including the haptic structure, seat, accessories, or the video game software, without the prior express authorization of the service provider. Any unauthorized act of modification or alteration may result in immediate termination of the rights to use the simulator and the user's responsibility toward the service provider for any damage resulting from these unauthorized modifications.

6. Pricing
The prices indicated on our booking forms are inclusive of taxes. Additionally, World Sim Racer reserves the right to adjust its rates based on fluctuations in the cost of external services, taxes, and other relevant factors.

7. Payment and Booking
The user makes payment exclusively through the payment methods indicated on the booking site. A payment confirmation is sent via email, along with a QR code allowing access to the simulator session.
World Sim Racer reserves the right not to validate your order for any legitimate reason, particularly if:
● It does not comply with these general terms and conditions
● A previous order was not fully paid on time
● A payment dispute regarding a previous order is being processed
● Several serious and consistent elements raise suspicion of fraud regarding your order
● The customer caused damage to the equipment due to non-compliant use previously.

8. Cancellation and Modification
The booking of a simulator session cannot be canceled after purchase. However, sessions can be used within a calendar period of 15 days following the purchase date, subject to availability.

9. Withdrawal and Complaints
The Consumer Code grants the consumer a 14-day right of withdrawal for online purchases, allowing for a refund or exchange of the product. However, Article L.121-20-4 does not apply this right of withdrawal to leisure services to be provided on a specific date or according to a determined periodicity.
Complaints regarding the quality of the service provided must be sent by registered mail within 48 hours following the completion of the service, under penalty of forfeiture. These complaints do not justify any delay in payment. In the case of a justified complaint recognized by World Sim Racer, the responsibility of World Sim Racer will be limited to the portion of the operation not completed. No compensation will be provided for any expenses the customer may incur, regardless of the reasons.

10. Liability
The service provider cannot be held responsible for accidents, injuries, or damages resulting from incorrect, negligent, or abusive use of the simulator.
If an incident occurs due to improper use of the equipment by the client, the client will be responsible for paying for the part of the service not executed due to the incident.
The client remains responsible for any damage caused to the facilities made available to them.

11. Maintenance
World Sim Racer commits to regularly checking the simulator's condition to ensure its proper functioning. However, it is possible that the simulator may not function due to unforeseen reasons.

12. Refund
In the event that the simulator is not functioning and the user was unable to use it during the reservation period, World Sim Racer will refund the user. The implementation of this refund process is conditional upon confirmation that the simulator was not used due to technical issues, or that it stopped working during the gaming session.
The refund will be processed using the same payment method within 14 days.

13. Health and Safety
Individuals with pre-existing health issues or specific medical conditions should consult a healthcare professional before using the simulator. In case of pain, discomfort, or unusual symptoms, use must be immediately stopped.
World Sim Racer disclaims any responsibility for bodily injury resulting from the use of the simulator.

14. Intellectual Property
All intellectual property rights related to the simulator, including but not limited to patents, trademarks, and copyrights, are owned by the manufacturer of the simulator or the video game software or, if applicable, by the service provider.

15. Privacy and Data Processing
The user is informed that during their visits to the website www.worldsimracer.com, one or more cookies may be automatically installed on their computer. A cookie is a small file that does not identify the user but records information related to browsing on a site. The data collected is used to facilitate future navigation on the site and to enable various traffic measurements.
World Sim Racer commits to respecting the confidentiality of the data collected during the use of the simulator. No personal information will be sold, rented, or given to third parties for commercial purposes. The data collected will be processed in accordance with our privacy policy, available on our website, detailing the measures taken to ensure the security and confidentiality of users' personal information.
Additionally, by booking a simulator session, the user consents to providing their first and last name, which may be used to establish race rankings on our website or that of our partner.

16. Access and Behavior on the Site
The user agrees not to engage in illegal activities, extract or collect personal data from other site users in any way, extract, store, or exploit information for purposes other than display during browsing, store, disseminate, or publish any illegal, harmful, offensive, racist, hate-inciting, privacy-violating, or third-party rights-infringing content, store, disseminate, or publish any information revealing directly or indirectly an individual's religious affiliation, union membership, health status, or sexual orientation, submit content on behalf of a third party, impersonate another person, and/or publish personal information about a third party, and store, disseminate, or publish any content that may harm third parties, directly or indirectly.
The provider commits to ensuring 24/7 access to the site, except in cases of force majeure or events beyond the provider's control, and subject to possible outages and necessary maintenance interventions to ensure the proper functioning of the site and services. Therefore, the provider cannot guarantee the availability of the site and/or services, the reliability of transmissions, or the performance in terms of response time or quality.
The provider's liability cannot be engaged in the event of impossibility of access to the site and/or use of services. Additionally, the provider reserves the right to interrupt the site or part of the services at any time without prior notice, without the right to compensation.
The user acknowledges and agrees that the publisher is not responsible for interruptions and their potential consequences for the user or any third party.
The user declares consenting to the features and limitations of the Internet, acknowledging, in particular, that:
● The provider disclaims any responsibility regarding services accessible via the Internet and does not control the nature and characteristics of the data flowing through its server center.
● Data circulating on the Internet is not protected against potential hijacking. The communication of information considered sensitive or confidential by the user is done at their own risk.
● Data circulating on the Internet may be subject to usage regulations or protected by property rights. The user assumes full responsibility for the use of data they consult, query, and transfer on the Internet.
● The provider has no means of control over the content of services accessible on the Internet.

17. Modification of Terms
The service provider reserves the right to modify these general terms at any time. Users will be informed of any changes and are encouraged to consult them regularly.

18. Applicable Law
These general terms are governed by the laws in force in France. Any dispute arising from the use of the simulator will be subject to the competent jurisdiction.
By using the simulator, you acknowledge that you have read, understood, and accepted these terms and conditions of use.
